What happens if I take workers comp after a Kearney work accident?
The ER doctor may tell you, "This happened at work, so workers' comp should cover it." The insurance company will use that same fact to argue your employer is the only party you can go after.
That common answer is wrong.
In Nebraska, workers' comp is usually your exclusive remedy against your employer. That means you generally cannot sue your boss or company in regular court for a work injury. The claim goes through the Nebraska Workers' Compensation Court instead.
But that does not automatically block a lawsuit against a third party.
If someone other than your employer helped cause the injury, you may have two tracks at once:
- a workers' comp claim for medical care and wage benefits
- a personal injury claim against the outside person or company
That matters in central Nebraska. If you were hurt near Kearney because a defective machine, chemical supplier, outside maintenance contractor, or a negligent driver on a work trip caused the injury, workers' comp may pay benefits while you also pursue the third-party case.
Example: you are driving for work and get hit on US-77 by another driver. Your employer can raise the exclusive remedy defense to avoid being sued, but the at-fault driver is still fair game.
Nebraska law also gives the comp carrier a reimbursement right, often called a subrogation lien, against money recovered from the third-party case under Neb. Rev. Stat. § 48-118. That is where tax-season money stress gets real: a settlement is not all yours if comp paid bills.
For deadlines, a Nebraska personal injury lawsuit is usually 4 years. Workers' comp deadlines are different and can turn on the injury date, last payment, and notice issues.
If you use VA benefits, that is a separate system. VA care does not erase a workers' comp claim, and workers' comp does not erase a third-party lawsuit. The systems just do a poor job talking to each other.
